Grant of One Pre-Mature Increment on Grant of Selection Grade

Vide Finance Div (Regulation Wing) Islamabad O.M No. F.6 (13) Imp.II/91 dated 03-06-1992 one premature increment has been allowed on grant of selection grade.

According to the Finance Division para 4(ii) of O.M No. F.1 (12) Imp.II/91 dated 29-06-1991 & para 4(iii) of O.M NO. F.1 (12) Imp/91 dated 19-08-1991 on the subject noted above wherein the benefit of premature increment on the grant of selection grade has been allowed with effect from 01-06-1991.

The matter has further been reconsidered in the Finance Division and it has been decided by the competent authority that the civil employee who were granted selection grade prior to 01-06-1991 and were serving in selection grade posts on that date may also be allowed one premature increment for the purpose of fixation of pay wef 01-06-1991. Pay so fixed will be admissible from 01-06-1992.

These orders would not be applicable if the benefit of para 4(i) of Finance Div O.M dated 29-06-1991 and dated 19-08-1991 referred to above has already been allowed.

This supersedes clarification issued in Finance Division O.M No. 1(17) Imp.II/91 dated 09-9-1991.

Notification of Admissibility of Increments beyond the Scope of Pay Scales

Govt of the Punjab Finance Department has issued Notification No. FD.PC.2-2/2012 dated 14th January 2013 regarding admissibility of increments beyond the scope of Pay Scales.

According to Finance Department Punjab Notification No. FD.PC.2-1/2005 dated 16-01-2007 wherein it was, inter alia, clarified that all Govt Servants who have exhausted or may exhaust the relevant existing pay scales would be allowed the benefit of annual increment beyond the existing scope of the pay scales wef 01-12-2005 with no retrospective benefit, subject to the condition that the employee concerned has put in six month’s continuous service. The said benefit was to be treated as personal pay.

Vide Notification No. FD (PC)10-1/78(Pt-ii) dated 15-07-2011 whereby benefit of notional increment in the year of retirement (having at least six months’ service in the year of retirement) was allowed wef 01-06-2011 with no retrospective benefit.

In the light of above notifications, question has arisen as to whether the increments admissible in the following cases can also be allowed beyond the scope of pay scales:

  1. Premature Increment on promotion from lower post to higher post if the concerned civil servant is at the maximum stage of pay scales of higher post.
  2. The benefit of annual increment on notional/presumptive basis in the lower pay scale (at the maximum stage) in case of promotion after 1st June and civil servant opts for re-fixation of his pay in terms of Rule-10(3) of Pay Revision Rules 1977.

The matter has been considered in the Finance Department and it has been decided that in the above two cases increments if otherwise due may also be allowed beyond the scoping of pay scales. These increments so allowed shall be treated as personal pay. The amount of the personal pay may be treated as part of the pay scale of the concerned government servant for the purpose of fixation of pay, pension and the recovery of House Rent, etc.

However this concession shall be admissible only to those who shall be promoted on or after 01-01-2013. Any claim pertaining to a period prior to this date shall not be entertained.

Government of Sindh, Finance Department issued Notification No. FD/SR-I/1 (123)/06 dated 24th July 2007 regarding the clarification of Personal Pay (PP).

It has been clarified clearly in this Notification that the Annual Increment sanctioned as Personal Pay wef 01-12-2005 vide Finance Department O.M No. FD/SR-I/1 (123)/06 dated 21-11-2006 has to be treated as part of pay of the scale of Govt Servants for all purposes and as such there is no bar to allow Annual Increments wef 01-12-2006 and 01-07-2007 onward subject to prescribed conditions as long as the employee remains in the existing pay scale. Govt of the Punjab Finance Department has issued Notification No. FD.PC.40-147/2012 dated 16th March 2013 regarding Grant of Special Increment to the Accounts Clerk in the Punjab Province, applicable with effect from 1st July 2007.

Notification of Pre-Mature Increment to All the Upgraded Employees since 28-01-2002

Finance Division Regulation Wing Islamabad has issued Notification No. 11 (4) R-2/2011-1153/2013 dated 31st May 2013 in connection with the grant of Pre-Mature Increment on the up-gradation of the employees.

This decision has been made wef 28th January 2013 and all the employees who have been upgraded wef the same date are eligible to get the premature increment on their up-gradation of posts. As the Govt has not allotted the amount for the expenses of the same case in the financial year 2012-13 so the same amount will be allotted in the next budget 2013-14 to meet the expenses for the said cases.

Various appeals were submitted in the Federal Service Tribunal for the said purpose and the notification has been issued in consequence of these appeals. As the Supreme Court of Pakistan made a decision on 28-01-2002 so the benefit of the premature increment will also be applicable with effect from the same date.

When An Employee Can Get Two Increments?

An employee gets increments on various occasions in his/her service. I have already discussed in my previous posts about the annual increment and premature increment as well as usual increment. Annual increment is granted to an employee on 1st December every year on continuous 6 months service in a particular scale. Usual Increment is granted in the year of retirement of an employee when he/she retires on 1st June or later till 30th November. Premature Increment is allowed on promotion, re-appointment or up-gradation. However I am today discussing about the occasion where an employee will get two increments at the same time.

Two Increments at the Time of Promotion within the Scale

AN Employee can get two increment on promotion with in the same scale.

What Does Promotion Within The Same Scale Stands For?

I already discussed in my previous posts that when an employee promotes but he remains in the same scale i.e the designation of the employee changes but the pay scales remains the same. Suppose an LDC in BPS-09 (SG) promotes as UDC BPS-09 in this example the employee’s designation has been changed due to promotion but the basic pay scale remains the same. It means he/she has been promoted within the same scale. The second example is that in some departments a Supdt of BPS-16 on his promotion becomes Admin Officer but the Basic Pay Scale of the Admin Officer is also the same i.e 16.

Generally an employee can get two increments at the time of fixation of his/her pay whenever he/she is promoted within the same scale. In the above mentioned examples the employee will get two increments 1x increment is next above and the second one is premature increment. The example of this fixation is as under:

An LDC (SG) having basic pay 4375/- in BPS-07 on 01-05-2007 and he gets promotion his pay will be fixed as mentioned below:

When the Next above Stage of the New Scale Coincides with the Old Scale Stage

Some times when we fix the pay of an employee and the stages of the old pay scale and the new pay scale in which the pay is to be fixed coincides i.e the two stages are same, then the employee will also get two increments, 1x increment will be next above and the 2nd one will be premature increment. Suppose an employee having Rs. 31600/- in BPS-16 is promoted on 31-05-2012 to BPS-17, if we fix this pay in BPS-17, in BPS-17 there is also a stage of 31600/- . In this situation we will fix the pay as mentioned below:

Grant of BPS-17 to Baluchistan Schools SSTs & Option to Pix Pay after Annual Increment

Govt of Baluchistan Finance Department has issued Notification No. FD (R-I) III (40-41) 2013/2857-2887 dated 25th June 2013 in connection with the fixation of pay of the SSTs upgraded from BPS-16 to BPS-17, after annual increment 2012.  These SSTs were upgraded wef 01-07-2012 and in this case the service of 6 months is not completed so they were not entitled to get the annual increment of 2012.

In this notification it has been granted authority for all these SSTs (Secondary School Teachers) to retain their in BPS-16 upto 01-12-2012 to avoid the loss of one increment.

After availing the annual increment in BPS-16 on 01-12-2012, they are allowed to fix their pay in BPS-17 on 02-12-2012. If the Govt of Baluchistan Finance Department also issues the Notification of Premature Increment on up-gradation, then these teachers will also be eligible to get the premature increment on their up-gradation. The same notification has already been issued by the Finance Division Regulation Wing Islamabad for the Federal Govt Employees.

Admissibility of Increments beyond the Scope of Pay Scales

Govt of Pakistan Finance Division Regulation Wing, Islamabad has already issued Notification No. 3 (11) R.2/2011 dated 12th April 2011 in connection with the Admissibility of Increments beyond the Scope of Pay Scales.

With reference to Finance Division O.M No. F.1 (6)/Imp/2005 dated 18-10-2006, wherein it inter-alia, clarified that all those Govt servants who exhausted/may exhaust the relevant pay scales may be allowed the benefit of an annual increment beyond the existing scope of the pay scales wef 01-12-2005. The increment so allowed may be treated as personal pay subject to the condition that the employee concerned has put in six months or more service as count for annual increment unless withheld under the relevant rules. The amount of the personal pay may be treated as the part of the pay scale of the concerned Govt Employee for the purpose of fixation of pay, pension and recovery of House Rent Allowance.

In the light of above clarification, questions have arisen as whether the increments admissible in the following cases can also be allowed beyond the scope of pay scales:

  • Premature Increment on promotion from lower post to higher post if the concerned civil servant is at the maximum stage of the pay scales of higher post.
  • In the year of retirement if the concerned civil servant has completed six months in the pay scale in which he retires and he is at the maximum stage of his pay scales.
  •  The benefit of annual increment on notional basis/presumptive basis in the lower pay scale (at the maximum stage) in case of promotion after 1st June and a civil servant opt for fixation of pay in terms of Finance Division O.M No. 8 (2)G-Imp-I/75 dated 14-10-1976.

 

The matter has been considered in the Finance Division and it has been decided that in all the above three cases, increments if otherwise due, may also be allowed beyond the scope of pay scales. The increments so allowed shall be treated as personal pay and the grant of personal pay may be treated as the part of pay scale of the concerned Govt servant, Pension, Recovery of House Rent etc.  (This post has been delivered by Mr. Nafees Ahmad).

Premature Increment to SSTs Appointed Against 50 % in Service Quota

Government of the Punjab Finance Department already issued a Notification No.FD.PC-40-6-2007 dated 25th April 2009 in connection with the benefit of premature increment/ re-fixation of pay to serving SSTs appointed against the 50 % in service quota. I will express the matter with detail regarding Premature Increment to SSTs and also the same to ESTs. 

The said matter was examined in pursuance orders of the Honorable Lahore High Court, Lahore dated 09.04.2008 in subject writ petition.

2.   As  per  method  of  recruitment  originally  prescribed  in  the  Punjab Education  Department  ( School  Education ) recruitment  rules ,1987, the  post of secondary school teacher was required to be filled in 100% by initial recruitment subsequently, amendment was  made  in the service rules on 27.07.1991 according to which the post of SST was to be filled in as under:

“By initial recruitment, provided that 50 % post shall be filled from amongst   in service teachers possessing   prescribed   qualifications

For initial recruitment for the post of secondary school teacher”

3-  The   above  service  rules  were  further  amended  on  25-05-1983 according to which the post of SST was to be filled in as under:

(a)  50 %  of  the  post  shall  be  filled  in by initial recruitment  provided Further that:

(i)   75% from amongst the science graduates for appointment in the subjects of Mathematics, Science & Biology.

(ii)    25% from amongst graduates in Arts subjects.

(b)   50 %  posts  shall  be  filled  amongst  in service  teachers  possessing Prescribed qualifications   for   initial   recruitment   for  the  post of secondary school teacher provided that:

(i)    85  %  of  the   posts  shall  be   allocated  for  teachers  in  Arts subjects.

(ii)   15 % of the posts shall be allocated for teacher of Mathematics, Science & Biology, if none is available then from the in teacher in Arts subjects.                  4-  The rule ibid were further amended on 24.12.2008 according to which the post Secondary School Teacher is to be filled as under:-

(i)    50% of the post shall be filled in by initial recruitment provided further that:

(a)   75 % from amongst the science graduates (having the B.Sc qualification   with   three elective   subjects out of   (A) Mathematics (B) Physics, Chemistry, Botany, &Zoology.

(b)  25% from amongst graduates in Arts subjects.

(ii)   50  %  posts   shall  b e filled  in   by   promotion   from  amongst Elementary School Teacher (General, Technical, Agri, vernacular Arabic  Oriental,  Drawing,  Physical  Education, English) having prescribed  qualification  as  mentioned  in  column  No.  6 on the basis of  length of service  from the date of regular appointment in the respective District provided further that:-

(i)   75 % posts shall be allocated for teacher in Arts subject. 25  %  of  the  posts  shall  be allocated  Science Graduates (having  the  B.Sc qualification with three elective subjects out of (A) Mathematics (B) Physics, Chemistry, Botany, &Zoology.

5-  It  has been decided that the benefit of premature increment/ re-fixation of pay  may  be extended only those serving Secondary  School  Teachers appointed against the 50 %  in service quota from the date of appointment as Secondary School Teachers  whose  cases are at par with Mr Zaka Ullah and they were appointed on or after 27.07.1991,the date when service rules were amended .

Important Question regarding Premature Increment to ESTs

If SSTs can get the benefit of premature increment/ re-fixation of pay then why not PSTs appointed as ESTs, having the same situation, can get this benefit? Clarification Regarding Premature Increment on Upgradation

Govt of Pakistan Finance Division Regulation Wing has issued Notification No. F.No.11 (4) R-2/2013-1427 dated 22nd October 2013 regarding the clarification about the Premature Increment on Upgradation. The queries arisen by various Departments/Divisions/Departments/Organizations etc were examined in connection with the premature increment on upgradation. The clarification of the same is as under:

1 Whether the employees of BPS-01 to 04 who were moved one scale up wef 01-07-2007 without upgrading their posts are eligible for one premature increment under O.M F.No.11 (4) R-2/2011-1153 dated/2013 dated 31-05-2013. No. Finance Division’s O.M dated 31-05-2013 provides for grant of premature increment on upgradation and not on move up.
2 Whether the employees who were holding Selection Grade prior to up-gradation of their posts in BPS already held by them are also eligible to the benefit of premature increment on up-gradation of their posts. Yes. Just as in same scale promotion.
3 Whether the employees who were holding Selection Grade and were drawing pay at the maximum of their pay scales in which their posts had been upgraded are entitled to one premature increment as personal pay beyond the maximum of pay scales or otherwise. Since the annual increment beyond the scope of pay scales was first time allowed wef 01-12-2005 in BPS-2005, therefore the employees who were at the maximum of their pay scales in which their posts have been upgraded are entitled to get one premature increment as personal pay as is granted to same scale promotion wef 01-12-2005.
4 Whether the employees who have been upgraded or granted one scale move up on or after 2nd June of a calendar year can opt for re-fixation of their pay on 1st December of that calendar year in the light of Finance Division O.M No. F.3 (2) GAZ.IMP.I/75 dated 14-10-1975. Yes
5 Whether premature increment will be granted to inspectors of FBR who were upgraded twice 1st in 2008 and 2nd in January 2013 from BPS-11 to BPS-14 and BPS-14 to BPS-16 respectively. Yes
6 Whether premature increment is admissible on upgradation of contractual staff employed on standard terms and conditions of contract or otherwise. Contract Employees who have been appointed in a BPS on standard terms and conditions of contract appointment if upgraded along with post are entitled to get one premature increment as in case of regular employees.
7 a- Whether the Private Secretary/Stenographer (re-designated as APS), Steno Typist, who have been upgraded Vide O.M No. 19 (55) Legal-II/2010-1055 dated 23-12-2011, are entitled for premature increment on upgradation. a- Premature Increment is admissible in case of Steno Typists, Stenographers, only whose posts have been upgraded. The post of Private Secretary has not been upgraded rather they have been granted time scale on completion of prescribed length of service, therefore they have not been allowed premature increment.
b- If yes, what would be the criteria of admissibility of grant of premature increment and arrears on up gradation? b- Whether the stage in BPS of higher (upgraded) post next above the pay admissible in BPS of lower (pre-upgraded post), gives the increment in pay equal to or less than a full increment of higher post will be fixed after allowing a premature increment in BPS of higher post.

Advance Increments & M.Phil Allowance to Graduate English Teachers

Govt of the Punjab School Education Department has issued orders No. SO(SE-III)7-241/2013 dated 5th November 2013 in connection with the matter of Advance Increments & M.Phil Allowance to Graduate English Teachers. The detail is as under: 

  1. The    W. P    NO. 11269/3013 filed by Mr. Muhammad Shabbir, EST (English) Govt Elementary School lshaq Wala Muzaffargarh  and 04 others was disposed of by the honourable Lahore High Court;  Multan Bench; Multan with the direction to the respondent NO.1;  Secretary School Education to decide petitioners case in the light of judgment rendered by this court in writ petition NO.8395OF2012.
  2. The operation paragraph of judgment dated 07.11.2012 passed in with petition NO.8395/2012 is produced as under:“It  is an establish principle of law that once an Appex court decides some point of law that is applicable on all similarly placed persons. The respondents are not denying this fact but their defence is that the petitioner is hit by article 212 of the constitution of Islamic Republic of Pakistan. The argument of learned assistant advocate general; Punjab is of no use. As the petitioners are claiming the benefit of judgment of the honorable Supreme Court of Pakistan as they are on similarly placed position like the appellants of judgment passed by the learned Punjab Service Tribunal. In view of the above,  this petition is allowed and the petitioner case is declared at per with the case of the appellants of judgment passed by the learned Punjab Service Tribunal dated 04.10.2010.”
  3. The judgment dated 04.10.2010 passed in appeal  NO.1545/2010 is produced as under:                                                                                                             “The perusal of above noted notification issued by the govt. of Punjab Finance Department on 07.07.2007 leaves no room for doubt that despite discontinuity of the above noted concession/grant of increment w.e.f 01.12.2001;  all those officer/officials who had acquired higher qualification prior to 01.12.2001 were already entitled to get the benefit of advance increments if otherwise eligible under the policy; meaning there by that the relevant date for acquiring higher education during service for getting the relief under 1983 notification was that the same should have been acquired prior to 01.12.2001; therefore were entitled to claim benefit of para-15 (iii) of notification dated 25.08.1983. Resultantly all these appeals are allowed and the appellant are declared eligible for grant of increments under notification dated 25.08.1983 provided they have earlier not availed the said concession in respect thereto .”
  4. The judgment dated 07.11.2012 passed in writ petition NO. 8395/2012 upheld by the  honorable Supreme Court of Pakistan vide judgment dated 07.03.2013 was submitted to the Finance Department for necessary advise the department to implement the judgment to the extent of petitioners only.  Accordingly the petitioners in writ petition No. 8395/2012 were allowed advance increments on acquiring higher qualification of M.A, M.Ed etc.
  5.    In compliance to the court’s order following steps were taken:-

a). The  petitioners were afforded personal hearing and heard at length in the presence of Mr. Riaz Hussain Qureshi, litigation officer O/O EDO (Edu) Muzaffargarh;

            b). The available record was perused and following facts are observed:-                  i.  The Graduate English Teachers were recruited on contract basis in the year 1995 & 1997 and regularized vide letter No. SO(SE-IV)2-31/2004 dated 31.12.2004;                                                                                                                                                      ii  As per Notification No.FD;PC.2-1/83 dated 25.08.1983 issued y the Finance Department, PSTs, ESTs, ATS and SSTs were entitled  for advance increments. The Graduate English Teachers did not come under the purview of said Notification. However, vide notification N. SO(CONFDL:S) 1-13/90 dated  26-6-90 advance increments sanctioned by the Finance Department in para 15 of their notification No.FD.PC.2-1/83  dated 25.08.1983 were stopped.

         iii.   The Govt of the Punjab, Finance Department vide letter dated 03-11-2004 advised the Accountant General , Punjab that teachers who could not avail the benefit prior to 01-12-2001  due to any reason are not entitled for advance increment at this stage.

       iv. Prior to appointment and regularization of Graduate English Teachers, Finance Department vide letter No. FD.PR.12-5/84 (PT.II) dated 03-11-2004 had already stopped advance incements on attaining higher qualification.

       v.  The Govt of the Punjab, School Education department  vide notification No.SO(SE-III) 2-16/2007 dated 24-9-2007 approved higher  qualification allowance for Elementary School Teachers on acquiring higher qualification of M.A/M.Sc; and

     vi. The ESTs (English) are entitled for M.Phil Allowance at the rate of Rs.5000/- per month vide notification No.FD.SR-1/9-21/2011 dated 01-4-2013.

6.  The Department vide letter No. SO(SER-II) 7-241/2013 dated 31-10-2013 has requested the Finance Department to issued necessary advice on the judgment dated 23-09-2013 passed in write petition No.112369/2013.

7.  In view of the above, I, Secretary School Education hereby dispose of the petition of petitioners, Mr. Muhammad Shabbir , EST (English) Govt. Elementary School Ishaq  Wala Muzaffargarh and 04 others, subject to advice issued by the Finance Department.

Clarification regarding Grant of One Special Advance Increment to the Employees holding Selection Grade prior to Up-Gradation-KPK Employees

Notification No. FD (SOSR-1) 2-123/2013 dated 31st December 2013 has been issued by KPK Govt in connection with clarification regarding Grant of One Special Advance Increment to the Employees holding Selection Grade prior to Up-Gradation of their posts in BPS already held by them. Thus the employees of KPK are eligible to get the Premature Increment on Upgradation.

With reference to Finance Department KPK Notification No. FD (SR-1) 2-4/2008 dated 04-04-2009, it is stated that certain queries have been received from different quarters as to whether the employees, holding selection grade prior to their up-gradation of posts in BPS already held by them, are also eligible to the benefit of premature increment on up-gradation of their posts.

In this connection, the provincial Government in consultation with Government of Pakistan, Finance Division, has to clarify that one special advance increment is admissible also to the employees who were holding selection grade prior to their upgradation of posts in Basic Pay Scales already held by them, just as in case of same scale promotion.

Grant of Premature Increment on Promotion within the same Scale-KPK Employees

Government of the Khyber Pakhtunkhwa, Finance Department has issued Notification No. FD (SOSR-1) 2-123/2014 dated 21st February 2014 in connection with Grant of Premature Increment on Promotion within the same Scale.

According to this Notification one premature increment is admissible to the employees who are promoted to the higher scale while they are already drawing the pay of that higher post.

In pursuance of the Finance Division Regulation Wing, Islamabad Notification No. F.11 (30) R-2/2010-1150 dated 5th November 2012, regarding Premature Increment on Promotion within the Same Scale, the Competent Authority is pleased to allow 1x premature increment in the pay scales of the higher post in case of fixation of pay on promotion within the same pay scale in all cases of promotion to higher posts having the same Basic Pay Scales. It means the employees having the said promotion, now will be admissible to the following benefits:-

  1. One Advance Increment as Next Stage
  2. One Premature Increment

It means that the employees who are promoted within the same scale will now get two increments instead of one increment.

This Notification also removed the confusion of many employees who were in confusion that according to the Finance Division Notification, they will get only one increment. Now according to this notification they will get two increments.

Re-Fixation of Pay on Re-appointment after Allowing Annual Increment in the Previous Scale

Government of the Pakistan Finance Division has issued Office Memorandum No. 2(1)/R-I/2009-1030 dated 27th May 2010 in connection with Re-Fixation of Pay on Re-appointment after allowing annual increment in the previous scale. The option of fixation of pay after getting annual increment in the previous scale on re-appointment was granted to Mr. Muhammad Asif Akram, Senior Auditor who was earlier working in BPS-05 and then re-appointed in BPS-11.

This office memorandum of the Finance Division clears the anomaly of the fixation of the pay on re-appointed in case the employee is re-appointed after 1st June. In this situation, the employee will get the annual increment as usual in the previous pay scale on 1st December and then he will fix his pay in the new pay scale. It is further added that the premature increment on re-appointment is already in vogue.

With reference to the Office of the Accountant General Pakistan Revenues letter No. TM/HA/1-73/Misc/Clarification/287 dated 28th October 2009, on the subject and it is clarified that appointment from one post to another involving assumption of duties carrying greater responsibilities for the purpose of FR-22 & FR-80 has been treated at par with promotion for fixation of pay in terms of O.M No. F.1(2)NG-Imp/71 dated 16th December 1977.

Accordingly, the benefit of annual increment based on the option as provided in O.M of 14th October 1975 is meant for fixation of pay on promotion with a view to avoid loss of the annual increment for the relevant calendar year in cases in which the condition of at least 6 months service which otherwise counts for the purpose, is true and is admissible in the case under reference.
